Pharmaceutical Imports from India: When Customs Clearance Becomes a Problem

In pharmaceutical imports from India, tariff classification is not just about duty rates. In many cases it determines whether the goods can be released for free circulation in the European Union and which additional regulatory requirements may apply.

In one case we handled, the customs declaration had already been accepted and the goods had entered the EU. However, the tariff classification was sent for verification. In practical terms, this means one thing. The cargo stops moving and the cost meter starts running.

When customs authorities question the tariff code, the clearance process can be suspended. The goods remain under temporary storage until the issue is clarified.

Every day of delay creates real consequences for the importer:

  • storage charges continue to increase
  • production and sales teams face growing pressure
  • delivery schedules begin to shift
  • financial settlements may require adjustments
  • there is a potential risk of customs debt
  •  

At this stage the issue was no longer about documents. The key question was the correct procedural decision.

One option was to keep the declaration in place and attempt to amend it. However, amendments to an accepted declaration are only possible in specific circumstances.

The alternative was to invalidate the declaration and submit a new one. In practice, this would restart the process and extend the storage period.

The goods were already under temporary storage, which meant every additional hour worked against the importer.

What we did?

We first assessed the procedural risks before making any decision.

At the same time, we prepared a technical justification for the tariff classification based on detailed product data. This allowed the issue to be clarified before the situation escalated into a formal customs procedure.

The result

The goods were released for free circulation without escalation and without additional duties.

The storage period was kept to a minimum, which allowed the importer to avoid a cascade of additional costs.
